1 Acceptance of Terms

By downloading, installing, or using the GymFit application or website (collectively, the "Service"), you agree to be legally bound by these Terms and Conditions ("Terms") and our Privacy Policy.

If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and GymFit Technologies Pvt. Ltd.

2 Eligibility

To use GymFit, you must:

• Be at least 13 years of age
• Users aged 13–17 must have parental or guardian consent
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law
• Provide accurate and truthful registration information

GymFit reserves the right to refuse access to any person who does not meet these eligibility requirements.

3 Account Registration & Security

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information as needed
• Keep your password confidential and not share it with others
• Notify us immediately of any unauthorised access to your account
• Take responsibility for all activity that occurs under your account

GymFit is not liable for any loss or damage arising from your failure to maintain account security.

One Account Per Person

Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions or obtain promotional benefits is strictly prohibited.

4 Subscriptions & Payments

Free & Premium Plans

GymFit offers both free and paid subscription tiers. Premium features are available through monthly or annual subscription plans.

Billing

• Subscriptions are billed in advance on a recurring basis
• Payment is processed through Google Play, App Store, or our secure payment gateway
• Prices are in Indian Rupees (INR) and are inclusive of applicable taxes
• We reserve the right to change pricing with 30 days' notice

Cancellation & Refunds

• You may cancel your subscription at any time through your store account settings
• Cancellation takes effect at the end of the current billing period
• Refunds are generally not provided for unused portions of a subscription period
• Exceptions may be made at GymFit's sole discretion in cases of billing errors

5 Acceptable Use Policy

You agree to use GymFit only for lawful purposes. You must not:

• Reverse engineer, decompile, or disassemble any part of the app
• Scrape, crawl, or harvest data from the Service using automated tools
• Attempt to gain unauthorised access to our systems or other users' accounts
• Upload or transmit viruses, malware, or any harmful code
• Use the Service to spam, harass, or harm other users
• Impersonate GymFit, our staff, or other users
• Reproduce, distribute, or resell GymFit content without written permission
• Use the Service for any commercial purpose without our consent

Violation of this policy may result in immediate account termination without refund.

6 Health & Fitness Disclaimer

Before starting any fitness programme, you should:

• Consult a qualified physician or healthcare provider, especially if you have pre-existing medical conditions
• Disclose any injuries, chronic conditions, or physical limitations to your doctor
• Stop exercising immediately if you experience pain, dizziness, or shortness of breath

GymFit trainers are fitness professionals, not medical doctors. Any health-related information in the app is general in nature. By using GymFit workout content, you acknowledge and assume all risks associated with physical exercise.

GymFit Technologies Pvt. Ltd. is not liable for any injury, illness, or adverse health outcome resulting from use of our content.

7 Intellectual Property

All content on GymFit — including but not limited to workout videos, training programmes, graphics, logos, text, music, and software — is the exclusive property of GymFit Technologies Pvt. Ltd. or its licensors and is protected by Indian and international intellectual property laws.

• You may not copy, reproduce, distribute, or create derivative works from our content
• You may not use our trademarks or brand assets without prior written consent
• Screen recording or downloading of premium video content is strictly prohibited

GymFit grants you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes only.

8 User-Generated Content

If GymFit allows you to post comments, reviews, progress photos, or other content ("User Content"), you retain ownership of your content but grant GymFit a worldwide, royalty-free, perpetual licence to use, display, and distribute it within the Service.

You agree that your User Content will not:

• Be false, misleading, or defamatory
• Infringe any third-party intellectual property or privacy rights
• Contain nudity, violence, hate speech, or illegal content
• Include personal information of other individuals without their consent

GymFit reserves the right to remove any User Content that violates these Terms without notice.

9 Limitation of Liability

To the maximum extent permitted by applicable law, GymFit Technologies Pvt. Ltd. and its directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or business interruption
• Physical injury or health complications arising from use of fitness content
• Temporary unavailability of the Service due to maintenance or technical issues
• Unauthorised access to or alteration of your data by third parties

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to GymFit in the 12 months preceding the claim.

10 Termination

Termination by You

You may close your account at any time by contacting us at support@gymfit.app. Account closure does not automatically entitle you to a refund.

Termination by GymFit

We may suspend or permanently terminate your account, without notice or liability, if you:

• Violate any provision of these Terms
• Engage in conduct that is harmful to other users or GymFit
• Fail to pay subscription fees when due
• Provide false information during registration

Upon termination, your licence to use the Service ends immediately and your access to premium content will be revoked.

11 Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute arising from these Terms or use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana, India.

12 Changes to These Terms

GymFit reserves the right to modify these Terms at any time. When changes are made, we will:

• Update the "Last updated" date at the top of this page
• Send an in-app notification for significant changes
• Email registered users for material changes that affect your rights

Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
